Under English law, parents cannot legally agree to a permanent "clean break" regarding child maintenance. Even if a consent order awards a lump sum or equity buyout in lieu of child support, either parent retains the statutory right to apply to the CMS after 12 months.

Legal Precedent

The 12-Month Rule Under Section 8(5) Child Support Act 1991

Court Order Horizon

Months 1 to 12 (Protected Period)

A Financial Remedy Consent Order approved by the Family Court bars the CMS from accepting an application from either party. Maintenance follows the court order strictly.

Month 13+ (Statutory Vulnerability)

Either parent has an unrestricted right under Section 8(5) to apply to the CMS. The CMS assessment overrides the court order, completely ignoring any prior lump sum or equity sacrifice.

Why There Is No True "Clean Break" for Child Maintenance

Under English family law, while a divorcing couple can achieve a final "clean break" regarding spousal maintenance and pension sharing, parents cannot contract out of child maintenance. The welfare of the child is paramount, and the state preserves the right to ensure parents contribute according to their ongoing financial ability.

Under Section 8(5) of the Child Support Act 1991, a court order dealing with child maintenance only bars an application to the Child Maintenance Service for exactly 12 months from the date the order was made.

The Risk of Equity Offsets in Divorce Settlements

A dangerous mistake made during divorce negotiations occurs when a paying parent transfers their share of the family home equity (e.g. £50,000) to the resident parent in exchange for an informal or drafted agreement that no monthly child maintenance will ever be sought.

Once 12 months elapse, the resident parent can legally approach the CMS. The CMS will assess child maintenance based on the paying parent's current gross income, with zero discount or credit given for the £50,000 equity surrendered. The court has very limited power to compel the return of the capital.

Segregated Deed of Covenant and Segregated Capital Structures

Where high-net-worth parents genuinely wish to pre-fund child maintenance, family solicitors use specialized trust structures, school fee orders, or deeds of covenant with indemnity clauses that hold capital in escrow rather than gifting equity outright.

Frequently Asked Questions: CSA Settlement Calculator

Authoritative answers based on current statutory rules and legal precedents

Can a judge order a clean break for child maintenance? ↓
No. Family Court judges have no legal power to make a clean break order for child maintenance. Any clause attempting to do so is void as contrary to public policy.
What happens if my ex-wife agreed to no maintenance in our divorce consent order and then applies to the CMS after 2 years? ↓
The CMS will calculate statutory liability and enforce payments against you. Your consent order cannot prevent the CMS from acting once the initial 12-month period has passed.
Can the court penalize a parent who applies to the CMS in breach of an agreement? ↓
Only if the consent order contained a valid indemnity or variation undertaking tied to spousal maintenance or property adjustment, allowing the paying parent to apply back to the court for financial compensation.
