The 5 Statutory Overnight Care Tiers Under Regulation 46

Under Regulation 46 of the 2012 Regulations, shared care is evaluated strictly by night counts. A night counts if the child stays overnight with the paying parent, regardless of whether the stay occurs on a weekday or weekend. The five statutory bands establish progressive discounts:

Staying 51 nights provides zero discount, whereas reaching 52 nights immediately unlocks a 1/7th discount, saving hundreds of pounds. Reaching 104 nights doubles the discount to 2/7ths, and reaching 175 nights cuts the payment in half plus £7 per child per week.

Calculating Night-by-Night Discounts and Annual Savings

Many parents assume they only receive credit for alternate weekends (26 weekends = 52 nights). However, factoring in half of all school holidays (typically 1 to 2 weeks at Christmas, 1 to 2 weeks at Easter, and 2 to 3 weeks during summer) adds another 28 to 35 nights, lifting the total to 80 to 87 nights per year.

Adding a single regular midweek overnight stay every other week (13 nights) can elevate a parent across the 104-night threshold into Tier 2 (2/7ths discount), dramatically reducing monthly outgoings.

Equal Shared Care (Regulation 50) and the Day-to-Day Carer Test

Where care is shared equally (175+ nights, usually alternating weeks or 2-2-3 rotas), liability is cut by 50% plus an additional £7/week per child under Regulation 46. Under Regulation 50, if parents share day-to-day care exactly equally, the parent who does NOT receive Child Benefit is classed as the paying parent.

Courts and the CMS look at who handles GP appointments, school uniform purchasing, and primary administrative duties when determining primary carer status in disputed equal care arrangements.

Legal Clarifications

Frequently Asked Questions: Child Maintenance Calculator Overnight Stays

Authoritative answers based on current statutory rules and legal precedents

How many nights per year do alternate weekends provide? ↓
Alternate weekends provide exactly 52 nights per year (26 fortnights × 2 nights). This precisely meets the Tier 1 threshold for a 1/7th statutory reduction.
What happens if I have 51 nights of overnight care? ↓
If you have 51 nights, you receive 0% reduction. Under Regulation 46, you must reach at least 52 nights to receive the 1/7th discount.
How do school holidays increase my shared care tier? ↓
Adding half of all school holidays (Christmas, Easter, half-terms, and summer) typically adds 21 to 35 nights. Adding this to 52 alternate weekend nights brings your total to 73–87 nights, solidifying your Tier 1 entitlement.
Can having 2 midweek overnight stays push me into Tier 2? ↓
Yes. Having 1 regular midweek overnight stay every week provides 52 nights. Combined with alternate weekends (52 nights), your total reaches 104 nights, unlocking the Tier 2 (2/7ths discount).
Does an overnight stay require the child to sleep at my registered home? ↓
Yes. An overnight stay requires the child to stay the night under your physical care, whether at your primary residence, a holiday home, or during a holiday trip.
Can my ex-partner refuse overnight stays to prevent maintenance reductions? ↓
If a receiving parent deliberately blocks contact to inflate maintenance, the paying parent should apply to the Family Court for a Child Arrangements Order to legally enforce overnight schedules.
