Core Tool Boundaries & User Principles at a Glance
✓ Statutory Simulation Engine Only

CSA Calculator simulates calculations under the Child Support Maintenance Calculation Regulations 2012 for educational guidance, financial modeling, and amicable mediation. We do not provide formal legal advice or create a solicitor-client relationship.

✓ Independent from Crown & DWP

We are an independent British LegalTech initiative. We are NOT operated by, affiliated with, endorsed by, or connected to the Department for Work and Pensions (DWP), the Child Maintenance Service (CMS), or HMCTS.

✓ Zero-Knowledge Privacy Architecture

All computations occur strictly client-side within your browser's local RAM. We do not store, log, or transmit your gross earnings, payslips, pension amounts, or child details to our servers.

✓ Enforceable Statutory Orders

Our figures provide a neutral benchmark for voluntary Direct Pay standing orders. Legally binding, enforceable maintenance orders must be formally executed by the official CMS or ordered by the Family Court.

1. Agreement to Terms & Legal Capacity

These Terms and Conditions of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and CSA Child Maintenance Assessment Platform Ltd (trading as "CSA Calculator", "we", "us", or "our"), governing your access to and use of https://csacalculator.net, including all 44 specialized calculator modules, statutory guides, localized subdirectories, and print export utilities.

By accessing, browsing, or utilizing this website, you confirm that you have read, understood, and agree to be bound by these Terms and our accompanying Privacy Policy. If you do not agree with any part of these Terms, you must discontinue your use of this platform immediately.

You affirm that you are at least 18 years of age and possess the full legal capacity to enter into binding contracts under English law. If you access the service on behalf of a family law firm, mediation practice, or legal advisory service, you represent and warrant that you hold the legal authority to bind that entity to these Terms.

2. Nature of Service: Educational Simulation & Non-Solicitor Advisory

CSA Calculator provides algorithmic calculation engines, educational summaries, and comparative financial tooling based on the published statutory formulas contained within the Child Support Act 1991, the Child Support Maintenance Calculation Regulations 2012 (SI 2012/2677), and devolved UK statutes.

Important Legal Boundary: No Solicitor-Client Relationship

Nothing published on this website, computed by its JavaScript engines, or communicated by our advisory desk constitutes formal legal advice, financial advice, or a solicitor-client retainer. CSA Calculator is not a law firm, does not act as court advocates, and is not regulated by the Solicitors Regulation Authority (SRA) or the Bar Standards Board (BSB).

The figures generated by our calculators are intended strictly for informative modeling, personal budgeting, and amicable mediation negotiation between separated parents. For enforceable child maintenance orders, parents must either submit a formal application to the government Child Maintenance Service (CMS) or petition the Family Court under Schedule 1 of the Children Act 1989.

3. Algorithmic Gateways, Accuracy & Discrepancy Warnings

We strive for institutional precision. Our calculation algorithms are calibrated to mirror the six statutory gateways established under UK secondary legislation:

  • Gateway 1: Gross weekly assessable earnings aggregation (HMRC Real-Time Information equivalent under Regulations 34–36, including SA302 net profits).
  • Gateway 2: 100% allowable pension relief deductions under Regulation 37 (occupational schemes, personal pensions, and SIPPs).
  • Gateway 3: Resident child household percentage discounts under Regulation 44 (11% for 1 child, 14% for 2 children, 16% for 3+ children).
  • Gateway 4: Statutory Rate Bands: Nil (<£7), Flat (£7–£100), Reduced (£100–£200), Basic (£200–£800), Basic Plus (£800–£3,000), and the statutory cap of £3,000/week gross (£156,000/year).
  • Gateway 5: Qualifying child multipliers (12% for 1 child, 16% for 2 children, 19% for 3+ children on Basic rate bands).
  • Gateway 6: Regulation 46 shared care overnight deductions (1/7th, 2/7ths, 3/7ths, and 50% plus £7/child/week equal care discount).

Why official government assessments may differ:

An official notice issued by the CMS may diverge from our calculations due to administrative or factual discrepancies outside algorithmic modeling:

  • HMRC Timing Lag: The CMS assesses income using prior-year HMRC tax figures unless a parent formally proves a verified 25% change in current gross income.
  • Unreported Pensions: The CMS may lack documentation regarding personal SIPP or workplace pension relief if contributions are not automatically captured via PAYE.
  • Disputed Overnight Counts: In the absence of a formal Child Arrangements Order (CAO), the CMS may apply an assumed 52-night reduction if parents submit conflicting schedules.
  • Statutory Variations: Complex adjustments under the Child Support (Variations) Regulations 2012 (e.g. unearned dividend income, retained company profits, or assets exceeding £65,000).

Users remain solely responsible for verifying the accuracy of the numerical inputs entered into our calculator fields.

4. Independence from Government & Public Authorities

CSA Calculator is an entirely independent private platform.

We are not operated by, affiliated with, endorsed by, funded by, or associated with the Department for Work and Pensions (DWP), the Child Maintenance Service (CMS), the historical Child Support Agency (CSA), or HM Courts & Tribunals Service (HMCTS).

All references on this site to "Child Support Agency", "CSA", "Child Maintenance Service", "CMS", "DWP", or parliamentary statutes are made strictly for statutory citation, public legal education, and nominative fair use pursuant to Section 10(6) of the Trade Marks Act 1994.

5. Promotion of Amicable Direct Pay & Family Wealth Preservation

A core institutional mission of CSA Calculator is empowering parents to reach voluntary Direct Pay agreements. Under Direct Pay, parents use our verified statutory calculations to establish direct, zero-fee bank standing orders:

  • Paying parents avoid the government's 20% collection fee charged under Collect & Pay.
  • Receiving parents avoid the government's 4% deduction taken from their child's maintenance.
  • Direct Pay preserves 24% of transferred family capital (£1,248+ per year on an average £100/week assessment) exclusively for the welfare of the children.

CSA Calculator is an analytical tool and does not process banking transactions, hold client funds, operate escrow services, or collect child maintenance payments. All Direct Pay transfers occur directly between the parents' respective personal bank accounts.

6. Permitted Professional Use by Solicitors, Mediators & Citizens Advice

We grant an explicit, revocable, non-exclusive license to SRA-regulated family law solicitors, Resolution-accredited practitioners, Family Mediation Council (FMC) mediators, and Citizens Advice volunteers to:

  • Utilize CSA Calculator on screens during joint client conferences and roundtable mediation sessions;
  • Generate and print calculation summary schedules as reference exhibits for Form E financial disclosure bundles; and
  • Model hypothetical scenarios (e.g. pension changes under Reg 37 or overnight schedules under Reg 46) during without-prejudice negotiations.

Practitioners must ensure their clients understand that calculations are informative simulations of SI 2012/2677 and do not replace formal judicial adjudication or binding CMS maintenance orders.

7. Intellectual Property & Restrictions on Use

All software source code, interactive calculation scripts, user interfaces, visual design systems, SVG logos, brand marks, diagrams, tables, and original articles published on this platform are the exclusive intellectual property of CSA Child Maintenance Assessment Platform Ltd and are protected under the Copyright, Designs and Patents Act 1988 and international copyright treaties.

Restrictions: You agree not to copy, modify, republish, decompile, reverse-engineer, frame, mirror, or programmatically scrape any calculator algorithm, source script, or data set for commercial white-label distribution without our prior written consent.

8. Acceptable Use Policy

When accessing or using CSA Calculator, you agree that you will not:

  • Use the platform in any manner that violates applicable local, national, or international law or regulation.
  • Introduce software viruses, trojans, worms, logic bombs, or other malicious code designed to disrupt, compromise, or impair website infrastructure.
  • Attempt to gain unauthorized access to our administrative servers, cloud hosting accounts, or connected systems.
  • Execute automated scraping bots, spiders, crawlers, or data extraction scripts against our calculation modules without written API authorization.
  • Falsely represent our calculations as an official legally binding determination of the Crown, the DWP, or the Family Court.

We reserve the right to restrict or terminate access to any IP address or network that engages in abusive, malicious, or automated scraping activity.

9. Client-Side Processing Warranty

In accordance with our Privacy Policy, all financial calculations are processed client-side in your local browser memory. We warrant that our platform does not store, record, transmit, or log your personal salary, financial inputs, payslip information, or child details onto any backend server.

While we deploy modern 256-bit TLS/SSL encryption and secure hosting architectures, you remain responsible for maintaining the security of your own local device, web browser, and internet connection.

10. Disclaimers of Warranties

To the fullest extent permitted by applicable law (including the Consumer Rights Act 2015):

  • CSA Calculator is provided strictly on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, statutory, or otherwise.
  • We make no representations or warranties regarding the completeness, timeliness, reliability, or 100% continuous uninterrupted availability of the platform.
  • We do not warrant that our calculation results will exactly match any subsequent determination issued by an official CMS caseworker or an order made by a Family Court Judge exercising judicial discretion under Schedule 1 of the Children Act 1989.

11. Limitation of Liability

To the maximum extent permitted by English law, in no event shall CSA Child Maintenance Assessment Platform Ltd, its directors, officers, software developers, legal researchers, or contributors be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or in connection with:

  • Your use of or inability to access or use the calculation platform;
  • Any financial arrangements, bank standing orders, Direct Pay agreements, or private settlements established in reliance upon calculations generated on this site;
  • Any retroactive arrears assessments, enforcement charges, or deductions from earnings orders imposed by the Child Maintenance Service;
  • Any legal fees, mediation disbursements, or court litigation costs incurred in connection with child maintenance disputes; or
  • Any errors, bugs, inaccuracies, or calculation omissions in our software scripts or statutory guides.

Unwaivable Statutory Rights: Nothing in these Terms shall limit or exclude our liability for death or personal injury resulting from our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under the laws of England and Wales.

12. External Links & Third-Party Services

Our website and blog articles contain links to external resources, including official legislation databases (legislation.gov.uk), government portals (gov.uk), and registered family charities (such as Gingerbread and National Family Mediation).

These links are provided purely for statutory reference and convenience. We have no control over the content, security, or privacy practices of external third-party websites and accept no responsibility for them or for any loss or damage that may arise from your use of them.

13. Devolved UK Jurisdictions & International Use

While child maintenance is a reserved matter for England, Wales, and Scotland under the 2012 CMS scheme, specific devolved rules apply:

  • Scotland: Claims for aliment under the Family Law (Scotland) Act 1985 remain subject to the jurisdiction of the Scottish Sheriff Courts or Court of Session where statutory CMS jurisdiction does not apply.
  • Northern Ireland: Child maintenance is administered by the Child Maintenance Service Northern Ireland under devolved legislation (Child Support (Northern Ireland) Order 1991).
  • International Reciprocity (REMO): Where one parent resides outside the UK in a reciprocating country under the 2007 Hague Maintenance Convention, our REMO modules provide guidance, but enforcement is governed by international treaty law.

14. Governing Law & Exclusive Jurisdiction

These Terms of Service, their subject matter, and their formation (including any non-contractual disputes or claims) shall be governed by and construed exclusively in accordance with the laws of England and Wales.

Subject to mandatory consumer protection laws in Scotland and Northern Ireland, you and CSA Calculator irrevocably agree that the Courts of England and Wales shall have exclusive jurisdiction to settle any dispute, claim, or controversy arising out of or in connection with these Terms or the use of this website.
