Statutory Age Thresholds: 16, 18, 20 and the Scottish 25 Rule

Age Visual
Age 16
Compulsory School Age

Liability ends if child leaves education. If child stays in sixth form or college, maintenance continues.

Age 18
Legal Adulthood

Turning 18 does NOT stop CMS maintenance if young person remains in college or sixth form.

Age 20
Absolute CMS Cap

Absolute statutory ceiling for CMS in England, Wales, and Northern Ireland. Ceases on 20th birthday.

Age 25 (Scotland)
Sheriff Court Aliment

Adult university students can sue parents directly in the Sheriff Court under Scots law until their 25th birthday.

Statutory Age Thresholds: 16, 20 and the Scottish 25 Rule

Under the Child Support Act 1991, child maintenance obligations do not automatically expire on a child's 18th birthday. If a young person remains in full-time non-advanced education (such as sixth form, college, or Level 3 BTEC courses), statutory maintenance continues up until their 20th birthday.

In Scotland, the age ceiling is significantly higher: under Section 1(1) of the Family Law (Scotland) Act 1985, young adults attending university or in vocational training have an independent statutory right to sue for parental aliment up to age 25.

The Four Official Child Benefit Terminal Dates

Child maintenance does not stop on the day exams finish. Instead, liability continues through the summer holiday up to the official statutory terminal date set by Child Benefit regulations:

  • • Last day of February: For education ending in December/January
  • • 31 May: For education ending in March/April
  • • 31 August: For education ending in May/June (standard GCSE & A-Level terminal date)
  • • 30 November: For education ending in August/September

Lawful Cessation vs False Arrears Claims

One of the most frequent administrative errors occurs when paying parents unilaterally cancel standing orders on a child's 18th birthday while the child remains in college. This generates rapid automated arrears and risks a 20% Collect & Pay penalty fee.

Conversely, if a child leaves college early, enters full-time employment, or starts a paid apprenticeship, the paying parent must immediately notify the CMS with documentary evidence to have the assessment closed as of the exact cessation date.

Frequently Asked Questions: Child Maintenance Calculator Age

Authoritative answers based on current statutory rules and legal precedents

At what exact age does child maintenance stop legally? ↓
Child maintenance stops on the child’s 16th birthday if they leave full-time education. If they stay in full-time non-advanced education (such as A-Levels or college), liability continues until they finish the course or reach their 20th birthday, whichever comes first.
Does child maintenance continue through the summer holidays after exams? ↓
Yes. Maintenance continues until the statutory Child Benefit terminal date, which is August 31st following the completion of GCSEs, A-Levels, or college vocational courses.
What happens if a 17-year-old takes a gap year before university? ↓
If a 17 or 18-year-old leaves education and is not in approved training or education, Child Benefit terminates, and child maintenance stops immediately. It does not resume when they start university (except in Scotland under Scots aliment law).
Why is the age limit 25 in Scotland? ↓
Under Section 1(1) of the Family Law (Scotland) Act 1985, a child up to age 25 who is reasonably in education or training for a trade or profession can claim aliment from their parents directly through the Scottish Sheriff Courts.
Can a paying parent stop paying immediately when the child turns 18? ↓
No. Turning 18 does not automatically stop child maintenance if the young person is still in qualifying secondary education (e.g. Year 13). Stopping payments without CMS notification creates enforceable arrears and enforcement charges.
Does starting university stop child maintenance in England? ↓
Yes. In England and Wales, entering university (higher advanced education) immediately ends Child Benefit eligibility and terminates statutory child maintenance obligations under the CMS.
