How the CMS Apportions Maintenance Across Multiple Families

Apportionment Visual

Under Regulation 49, the CMS calculates one single global assessment based on the total number of qualifying children across all families (e.g., 1 child with Mother A + 1 child with Mother B = 2 children total, so the 16% rate is applied).

Step 1: Calculate Total Liability = Assessable Income × Total Children Rate (16%)
Step 2: Apportion by Child Ratio = (Mother A Children ÷ Total Children) × Total Liability
Step 3: Deduct individual shared care overnights separately for each household

Statutory Apportionment Under CMS Regulation 49

Where a paying parent has qualifying children with more than one receiving parent (e.g., Mother A and Mother B), the CMS does not perform two separate, uncoordinated assessments. Under Regulation 49 of the 2012 Scheme, the CMS assesses the paying parent's total liability across all children combined, and then apportions the payment proportionally based on the number of children living in each receiving household.

This statutory protection prevents the paying parent from being assessed at 12% twice (which would equal 24% of income); instead, the dual-child 16% rate is applied globally and split 8% to Mother A and 8% to Mother B.

Calculating Global Liability Across Multiple Households

The apportionment formula operates in three statutory stages:

  • 1. Establish total assessable gross weekly earnings (after pension deductions).
  • 2. Count the total qualifying children across all receiving parents to determine the statutory percentage rate (e.g. 1 child + 2 children = 3 children total, so 19% applies).
  • 3. Divide the total maintenance figure by the total child count and allocate to each household according to the number of children resident there.

Managing Multiple Direct Pay Accounts & Separate DEOs

Each receiving parent is assigned an entirely separate CMS case reference number. Direct Pay arrangements are set up independently, meaning the paying parent sets up two separate standing orders.

If one mother opts for Collect & Pay while the other accepts Direct Pay, the 20% DWP collection surcharge is applied only to the portion of maintenance paid through Collect & Pay, protecting the Direct Pay portion from penalty fees.

Frequently Asked Questions: Child Maintenance Calculator Multiple Mothers

Authoritative answers based on current statutory rules and legal precedents

How does the CMS calculate maintenance for children with different mothers? ↓
Under Regulation 49, the CMS calculates one global liability based on the total number of children across all mothers (e.g. 1 child with Mother A + 1 child with Mother B = 2 children total, so the 16% rate applies). This total is then apportioned proportionally between the households.
Does each mother know how much the other mother receives? ↓
No. Strict GDPR and data protection rules prevent the CMS from revealing the other mother’s identity, address, or specific payment amounts. However, each mother will be informed that an apportionment calculation has been applied.
What happens if I have 1 child with Mother A and 2 children with Mother B? ↓
With 3 children total, the 19% rate applies to your gross income. The total liability is divided into 3 equal shares: Mother A receives 1/3rd (approx. 6.33% of your income), and Mother B receives 2/3rds (approx. 12.67%).
How does shared care work with multiple mothers? ↓
Shared care is calculated separately for each household. If you have 52 overnight stays with Child A, a 1/7th deduction applies to Mother A’s apportioned payment only. Mother B’s payment remains unaffected unless you also have shared care with her children.
Can one mother force the case into Collect & Pay if the other uses Direct Pay? ↓
Yes. Each mother has an independent right to choose Direct Pay or Collect & Pay. If Mother A chooses Collect & Pay, the 20% fee is added only to her apportioned payment.
What if a child with Mother A turns 20 and leaves education? ↓
When Child A ceases to be a qualifying child, the case for Mother A closes. The CMS recalculates the remaining case for Mother B as a single-family assessment under the applicable 1-child or 2-child rate.
