Statutory Relief for Resident Children (11%, 14%, 16%)

Under the Child Support Maintenance Calculation Regulations 2012, the law recognizes that a paying parent who supports children living in their current household has reduced disposable income. Before calculating child maintenance for children living elsewhere, the CMS applies an automatic percentage reduction to gross earnings:

  • • 1 Resident Dependent Child: 11% gross income discount
  • • 2 Resident Dependent Children: 14% gross income discount
  • • 3 or more Resident Children: 16% gross income discount

The Legal Link Between Child Benefit & Household Discounts

To qualify for the household child discount, Child Benefit must be payable for the child in the paying parent's current household. Either the paying parent or their new cohabiting partner must be the designated recipient of Child Benefit.

This includes: (a) biological children born into the new relationship; (b) legally adopted children; and (c) step-children or a partner's children from a previous relationship living permanently as part of the family unit.

High Income Child Benefit Charge Tax Adjustments

If the paying parent or their partner earns over £60,000, they are subject to the High Income Child Benefit Charge (HICBC). Even if the partner opts out of receiving cash Child Benefit payments to avoid the tax charge, the child still qualifies for the 11%, 14%, or 16% CMS maintenance deduction, provided the underlying entitlement was registered with HMRC.

Legal Clarifications

Frequently Asked Questions: CSA Child Benefit Calculator

Authoritative answers based on current statutory rules and legal precedents

How much does having children in my current household reduce maintenance? ↓
Under the CMS 2012 scheme, having other dependent children living in your household reduces your gross assessable income by: 11% for 1 child, 14% for 2 children, and 16% for 3 or more children.
Do step-children count for the household child discount? ↓
Yes. If your new partner receives Child Benefit for step-children living permanently in your household, they count toward the 11%, 14%, or 16% gross income discount.
What if we opted out of Child Benefit because of the High Income Charge? ↓
You still qualify for the CMS discount. As long as you submitted the Child Benefit claim form and ticked the box to opt out of cash payments for tax reasons, the statutory link is verified by the CMS.
Does having a child in my household reduce my arrears debt? ↓
No. Household children discounts only reduce ongoing weekly liability from the date the child was born or reported to the CMS. They cannot reduce historical arrears.
What happens when a step-child turns 18 and leaves education? ↓
When Child Benefit stops for that step-child, your household discount drops (e.g. from 14% for 2 children to 11% for 1 child), slightly increasing your assessable income.
How do I prove a child lives in my household to the CMS? ↓
You can provide the Child Benefit reference number or a copy of your partner’s Child Benefit award letter through the CMS online portal.
