Dual Structure: Monthly Maintenance & Direct School Fee Orders

Maintenance Act

Monthly Cash Maintenance

Paid to the primary caregiver to cover groceries, cooking gas, domestic utilities, and general clothing items.

Direct School Fees & Levies

Magistrates routinely order school tuition fees, SDA levies, and uniforms to be paid directly to the educational institution to prevent misuse of funds.

Statutory Duty Under the Maintenance Act [Chapter 5:09]

Under the Maintenance Act [Chapter 5:09], a person who is legally liable to maintain another and fails to do so can be summoned to the Maintenance Court. In Zimbabwe, the duty of child support rests jointly on both parents in proportion to their respective means.

Multi-Currency Realities and Garnishee Orders

Because the Zimbabwean economy functions under a multi-currency regime (with widespread use of US Dollars alongside Zimbabwe Gold / ZiG), Maintenance Courts have the legal authority to award orders denominated in USD or split currencies. Section 22 of the Act allows the court to issue a Garnishee Order compelling the debtor's employer to deduct maintenance directly from salary.

Criminal Penalties for Default

Under Section 23 of the Maintenance Act, failing to comply with a maintenance order is a criminal offense punishable by a fine or imprisonment for a period not exceeding one year. Imprisonment does not extinguish accrued maintenance arrears.
