Trema-normen Two-Tier Draagkracht Architecture

Expertisegroep

Step 1: Behoefte (Child Financial Need)

Calculated using Nibud expenditure tables based on the combined net disposable family income during cohabitation, minus child-related budget (KGB).

Step 2: Draagkracht & Zorgkorting

Each parent's carrying capacity is calculated via the 70% formula. The paying parent's share is then discounted by 5% to 35% based on actual overnight contact days (Zorgkorting).

Dutch Statutory Foundation in Book 1 of the Civil Code

Under Article 1:392 of the Dutch Civil Code (Burgerlijk Wetboek - BW), parents have a statutory duty to provide maintenance to their minor children and young adults up to age 21. For children aged 18 to 21, the duty of maintenance continues under Article 1:395a BW as an obligation to contribute to living and study costs (levensonderhoud en studie).

The Trema-normen Carrying Capacity Formula

Dutch family judges adhere strictly to the Trema-normen established by the Expert Group on Maintenance Standards. The carrying capacity (draagkracht) formula for parents earning above the subsistence minimum is:

Draagkracht = 70% × [NBI - (0.30 × NBI + €1,175)]

The formula assumes 30% of income is spent on reasonable housing and sets a fixed living minimum (draagkrachtloos inkomen) of €1,175 to protect the parent's dignity.

The LBIO (National Maintenance Collection Agency)

If a parent defaults on court-approved kinderalimentatie, the receiving parent can transfer the case to the LBIO (Landelijk Bureau Inning Onderhoudsbijdragen). The LBIO acts free of charge for the creditor and charges an aggressive 15% collection surcharge directly to the defaulting debtor.
